Astralspace.net LLP Acceptable Use Policy

g. Unsolicited commercial email/Unsolicited bulk email. Using the Service to transmit any unsolicited commercial email or unsolicited bulk email. Activities that have the effect of facilitating unsolicited commercial email or unsolicited bulk email whether or not that email is commercial in nature, are prohibited.

h. Unauthorized access. Using the Service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Astralspace.net LLP or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data.

i. Copyright or trademark infringement. Using the Service to transmit any material (by email, uploading, posting, or otherwise) that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software. This also includes "cracked" software or software which "cracks" other software, such as keygen programs.

j. Collection of personal data. Using the Service to collect, or attempt to collect, personal information about third parties without their knowledge or consent.

k. Reselling the Service. Reselling the Service without authorization from Astralspace.net LLP.

l. Unfriendly activity. Using the Service (or allowing it to be used by others) for any activity which adversely affects the ability of other people to use Astralspace.net LLP Service or the Internet. This includes DDOS attacks of any kind. Astralspace.net LLP does not allow the hosting of eggdrops or IRC Related scripts/programs on our network. Accounts found hosting this material will be subject to immediate cancellation without refund. Interference with or disruption of other users, network Service or network equipment is prohibited. A Member may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A Member may not permit their website, through action or inaction, to be configured in such a way that gives a third party the capability to use their website in an illegal or inappropriate manner.

m. Server disruptions. To protect and maintain high availability of all servers, activities designed to cause harm to or monopolize the resources of any server in the Astralspace.net LLP network is prohibited. This includes, but is not limited to, the use of programs that consume excessive CPU time or memory; use of server space for backup or storage of material unrelated to the web site of an account; use of any provided mail services other than for the client's own account; use of servers to engage in any malicious or illegal activity, including unauthorized access to remote systems or providing the means for such access or engaging in any activity that can be used as a means to begin remote system penetration; distribution of viruses, worms, or any other electronic destructive resource; or maintaining or creating any free for all (FFA) type sites. CGI or php-based shell scripts are prohibited. This includes any script that is used for the purpose of issuing shell-level commands or which acts as a proxy for shell access via a web browser rather than the use of the embedded SSH client in the control panel or the use of a standalone SSH client. Such scripts will be deleted without notice when found. Use of such scripts may be grounds for account termination. Web proxy scripts are prohibited. This includes any script, such as nph-proxy, that allows anyone to browse to a third party web site from any server in the Astralspace.net LLP network or that otherwise masks the true origination point of browsing activities by use of network information associated with Astralspace.net LLP. Such scripts will be deleted when found. Violations may result in account suspension or termination.

n. Exceeding Web Site Size and Traffic Limitations: All Astralspace.net LLP members receive webspace with their Astralspace.net LLP account. Each member's webspace is allocated a certain amount of bandwidth per month. Our measure of bandwidth usage includes the bandwidth of all files uploaded to and downloaded from a member's site, as well as bandwidth used by e-mail. If a site exceeds its maximum monthly allotment of traffic, the site will become unavailable until the beginning of the next calendar month. A site that exceeds the Astralspace.net LLP member's maximum allotment in size will also become unavailable. Unavailability includes but may not be limited to the inability to access the site publicly, use e-mail related to the site, or to publish to or modify the site's contents via certain Web creation tools. Astralspace.net LLP reserves the right to charge a $5.00 reconnection fee if a user's site is suspended due to bandwidth or space overages.

o. Adult content. Astralspace.net LLP does not allow any form of pornographic content to be hosted on its Service. This includes (but is not limited to) images or video depicting nudity or sexual acts. Accounts that violate this policy may be suspended or terminated without further notice.

3. REPORTING VIOLATIONS OF ASTRALSPACE.NET LLP'S AUP

Astralspace.net LLP requests that anyone who believes that there is a violation of this AUP direct the information to: abuse@Astralspace.net.

If available, please provide the following information:

• The IP address used to commit the alleged violation
• The date and time of the alleged violation, including the time zone or offset from GMT
• Evidence of the alleged violation

Email with full header information provides all of the above. Other situations will require different methods of providing the above information.

Astralspace.net may take any one or more of the following actions in response to complaints:

• issue warnings
• suspend the Member's account
• terminate the Member's account
• bill the Member for administrative costs and/or reactivation charges
• bring legal action to enjoin violations and/or to collect damages, if any, caused by violations.

Astralspace.net LLP reserves the right to refuse, cancel, or suspend service in whole or in part at its sole discretion.

4. WAIVER OF LIABILITY

By using Astralspace.net LLP Service, you indemnify and hold Astralspace.net LLP (and its officers, directors, agents, subsidiaries, joint ventures and employees, and their successors and assigns), harmless from any claim, demand, action, liability, loss, damage or suit, including reasonable attorneys' fees, made by you or any third party due to or arising out of your breach of this Policy, your violation of any law or the rights of a third party. Astralspace.net LLP makes no warranties, expressly or implied, for this Service. This Service is offered on an "as is" basis, and customers waive all claims as noted above that may arise from the inability to use the Service as provided. The recourse available to customers should customers become dissatisfied with this Service, the terms of this Service, or any policy, practice, or guideline as set by Astralspace.net LLP will be limited to discontinuation of service as denoted in the Account Policies and Cancellation item below. This agreement is governed by the laws of the State of Indiana and the United States of America . Customers agree that all services provided by Astralspace.net LLP are deemed to have been requested in and provided in Marion County, Indiana, and that jurisdiction for any and all claims or disputes shall reside there.

5. Account Policies and Cancellation

Cancellation requests must be made via email to billing@astralspace.net or via the online ticketing system at http://www.astralspace.net/billing/. No other avenues of cancellation will be accepted. While no advance notice of cancellation is required, all fees paid for service to the point of cancellation are nonrefundable. Cancellations made within 30 days of beginning service are subject to the Astralspace.net LLP 30-day guarantee, and will result in a refund of fees paid. All fees paid for domain registration are nonrefundable, without exception.

Accounts are payable in full at the time of account creation. Any account reaching fourteen (14) days past due is subject to suspension for nonpayment. Such accounts are subject to termination after thirty (30) days in a past due state and will require payment of a $25.00 administrative fee for reconnection. All invoicing and payments are automatic and recurring based on the contract length specified by the client at the time of account setup or by request after setup has been completed. All invoices are due upon creation. Chargebacks issued for valid hosting fees will result in immediate account termination, without prior notice, and without exception.
